Please find below a reminder of the Terms and Conditions accepted when signing the application form. 
FANS French Market - Vendor Agreement

1. French Market 

The French Market is organised by the French-speaking Association of the North Shore (FANS), a not-for-profit association which runs the French-English bilingual program at Killarney Heights Public School. It is the main fundraising event for the association. 
It is an alcohol-free and dog-free event (except for guide dogs) inside a public school.

FANS will be referred as “Organiser” or “French Market Organiser” in this agreement.

2. Vendor(s)

All applicants will be referred to as “Vendor” or “Vendors” in this agreement once they have been accepted by the Organiser and have paid their invoice to secure their stall. 

3. Date

The 2024 French Market will be held on Sunday 17 November 2024 from 9am to 4pm.

4. Process

  • By 15 September 2024, online application forms must have been submitted. 
    The application cannot be processed if it is not complete (particularly regarding insurance and Food Safety Supervisor certificates)

  • By 1 October 2024, notifications of the outcome of the application process will be received. If successful, invoices and potential specific conditions (e.g. type of goods) will be sent.
    Acceptance of Vendors is at the discretion of the French Market Organiser.

  • By 15 October 2024, payment will be required to secure your booking.
    The final booking of a stall will only be guaranteed upon payment of the invoice.  

Payment of the invoice confirms your acceptance of the terms and conditions listed below.

5. Insurance

  1. All applicants must upload their Public Liability insurance (min $10 million) 
    Food Vendors should upload their Food Safety Supervisor or their Food Handling Certificate. 
    The application form will not be processed if the required documents are not uploaded.

    All Vendors must bring a copy of these relevant documents on the French Market day.

The French Market Organiser is not liable or responsible for lost, stolen or damaged goods and equipment before, during or after the event.

6. Stall space

  • All spaces are 3m x 3m. 

  • Vendors can book a maximum of three (3) spaces.

  • The location and allocation of stalls is at the absolute discretion of the Organiser. 

  • The location of the stall on market grounds will be communicated on set-up.

  • The Organiser reserves the right to move the position of any stall depending on weather impediments and other circumstances. 

7. Set-up and trading

Prior to market day:
            Vendors will be given an allocated time to Bump In. The Organiser will do its best to allocate times according to preferred time slots.
            Vendors must Bump In during their time slot, or may be refused access to the site.

On set-up:

  • Vendors will be advised of their exact position on site. 

  • Vendors are to set up only in their allocated space, and are to remain in that space irrespective of weather conditions, unless notified by the Organiser.

  • French Market volunteers will be in high-vis vests to assist with directions and queries, but Vendors are responsible for their own set-up. 

  • Vendors must be ready to trade at 8:30am.

On market day:

  • Vendors are to provide their own equipment (gazebo and weights - no pegs, tables, table covers, chairs, etc.). 

  • The use of a generator has to be pre-approved on application, and no un-silenced generators are permitted on the grounds. 

  • Vendors are responsible for their own equipment and goods before, during and after the event.

  • Vendors must operate within their 3x3m space, including for any promotional item or banner. 

  • Flyer or business cards distribution is limited to the vendor’s stall only.

  • No amplified music is permitted. 

  • Vendors must only sell goods and products as stated in their application form and approved by the Organiser. No sale of drinks is permitted unless specifically authorised by the Organiser.

  • No sale or consumption of alcohol is permitted on site.

  • Vendors shall ensure appropriate behaviour to all visitors at our family-friendly event.

  • Presentation of stalls must be of the highest standards.

  • The operating Vendor’s business must adhere to all applicable NSW Laws, including Trade Licences, Insurances and Permits.

  • Vendors cannot pack up and vacate the area until the completion of the event (4pm). 


8. Sustainability & waste management

  • In line with the NSW single-use plastic rules, plastic single-use cutlery, food ware, stirrers, straws and plastic bags are not permitted on the day of the event.

  • Vendors are responsible for the management of their waste, including removing their own rubbish from the site.

  • Under no circumstances can Vendors dispose of cardboard boxes and other waste items in the school’s rubbish tips which are exclusively used by the Organiser.

  • There is to be no washing up of equipment once service is complete.

9. Safety

Electricity:

  • Electricity is not supplied on market day except for pre-authorised Food Stalls.

  • The hot/food product stalls who need electricity are to notify the Organiser in their application form, and if stated, shall pre-pay the extra fee by the due date.

  • Vendors are to have all leads and equipment tagged in accordance with the statutory requirements, and ensure any leads and silenced generators are placed in such a manner so as not to create trip hazards or to present a hazard to the public through exhaust or heat. 

  • Electrical cables are to be heavy-duty construction standard and must have a circuit breaker.

Gas:

  • Unless pre-authorised, gas bottles are not permitted on the grounds.

  • If authorised, gas cylinders must be secured to avoid dislodgement. 

  • Fire extinguishers and fire blankets must be carried and ground sheets employed. 

  • Vendors are not to store flammable or toxic items.

Circulation:

  • Fire, emergency exits and aisles must be kept clear and boxes stored under tables or away from sight.

  • At set-up and pack-down, if there is vehicle access, vehicles are to be driven carefully around the site, and drivers must follow the Organiser’s instructions and directions at all times.

  • Particular care, courtesy and consideration are expected of Vendors while setting up and packing down. 

  • Vehicle access is not permitted on market grounds while the event is being held.

10. Promotion of event

  • The Organiser is responsible for the promotion of the event.

  • Vendors are expected to communicate about the event and/or share French Market / FANS posts on social media and other platforms.

  • By participating in this event, the Vendor grants permission to be photographed and agrees that their image may be used for promotional purposes related to this event or future events, including but not limited to social media and other advertising materials. 

11. Event Continuation, Refund Policy, and Liability

  • The French Market will go ahead rain, hail or shine unless otherwise determined by the Organiser.

  • If the holding of the event is prevented, delayed or abandoned by causes not within the control of the Organiser, Vendors agree that all fees are not refundable. 

  • Any payment made to the Organiser to confirm the booking is non-refundable and non-transferable to another Vendor or another edition of the event.

  • The Organiser shall not be held responsible for any costs incurred, loss of trade, or loss of profits resulting from the cancellation, delay, or any other issues related to the event.

12. Vendor agreement acceptance 

  • Payment of the invoice confirms your unconditional acceptance of the terms and conditions of the French Market 2024 Vendor Agreement.

  • Access to the market can be refused or a Vendor may be asked to leave the market at any time by the Organiser as a result of any breach of this Vendor Agreement.

  • As a result of such a refusal or expulsion, no refund or compensation will be provided.
